How Long Will My License Be Suspended?
The length of your potential license suspension will depend on the circumstances of your case and can last anywhere from 4 months to a lifetime. To further complicate the issue, both the court and the Department of Motor Vehicles (DMV) can suspend your license - independently of one another.
In a typical first-time DUI case where a person’s blood alcohol level was .08% or above, a 4 month suspension can result from the DMV hearing, and if the driver is at least 21, a restricted license can be obtained after the first month. However, if that person then suffers a DUI conviction in court based on the same offense, a six month suspension will be imposed, but the person is supposed to be given credit for the suspension time he has already served.
